CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION – RETURN CONDITIONS

GENERAL: When you place an order electronically through the website, you are deemed to have accepted the pre-information form and the distance sales agreement presented to you.

Buyers are subject to the provisions of the Consumer Protection Law No. 6502 and the Regulation on Distance Contracts (RG: 27.11.2014/29188) as well as other applicable laws regarding the sale and delivery of purchased products.

Shipping fees, including delivery costs for the purchased products, will be paid by the buyers.

Each product purchased will be delivered to the person and/or organization at the address indicated by the buyer within a maximum of 30 days, provided the legal period is not exceeded. If the product is not delivered within this period, the buyer may terminate the contract.

The purchased product must be delivered complete, in accordance with the specifications mentioned in the order, and, if applicable, with a warranty certificate and user manual.

If the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of learning of this situation and must refund the total price to the buyer within 14 days.

IF THE PRODUCT PRICE IS NOT PAID: If the buyer does not pay for the product or cancels the payment in the bank records, the seller is released from the obligation to deliver the product.

UNAUTHORIZED USE OF CREDIT CARDS: If, after the delivery of the product, it is determined that the credit card used by the buyer was fraudulently or unlawfully used by unauthorized individuals, and the product price is not paid to the seller by the relevant bank or financial institution, the buyer must return the product to the seller within 3 days, with shipping costs to be borne by the seller.

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS: If unforeseeable events or force majeure prevent the timely delivery of the product, the seller must inform the buyer. The buyer may request to cancel the order, replace the product with a similar one, or postpone the delivery until the obstacle is resolved. If the buyer cancels the order, the payment will be refunded within 14 days if made in cash. If the payment was made by credit card, the product price will be refunded to the bank within 14 days; however, the bank may take 2-3 weeks to transfer the amount to the buyer's account.

BUYER'S OBLIGATION TO INSPECT THE PRODUCT: The buyer must inspect the goods/services before accepting them. If any damage (such as crushed, broken, or torn packaging) is observed, the buyer should not accept the product from the courier. Any goods/services accepted by the buyer are deemed to be delivered in an undamaged and proper condition. After delivery, the buyer must carefully protect the goods/services. If the right of withdrawal is to be exercised, the product must not be used. The product must be returned with the original invoice.

RIGHT OF WITHDRAWAL: The buyer may exercise their right to withdraw from the contract by rejecting the product without providing any reason or assuming any legal or penal liability, provided they notify the seller through the contact information below within 14 days from the delivery of the product to themselves or a designated person/organization.

WITHDRAWAL PERIOD: If the buyer has purchased a service, the 14-day withdrawal period starts from the date of the contract. The right of withdrawal cannot be exercised for service contracts that have already commenced with the buyer's consent before the withdrawal period expires.

The costs of exercising the right of withdrawal will be borne by the seller.

The right of withdrawal must be exercised within 14 days by notifying the seller via registered mail, fax, or email. The product must not have been used, in accordance with the conditions of "Products for Which the Right of Withdrawal Cannot Be Exercised."

USE OF THE RIGHT OF WITHDRAWAL: The invoice for the product delivered to the buyer or to a third party (if the product was purchased on behalf of an organization, the return must include the return invoice issued by the organization). The product must be returned complete, with its box, packaging, and all standard accessories, undamaged.

RETURN CONDITIONS: The seller must refund the total amount to the buyer and return all documents that put the buyer in debt within 10 days of receiving the withdrawal notification. The seller is also obliged to accept the returned goods within 20 days.

If any decrease in the value of the product is due to the buyer's fault, or if the return becomes impossible, the buyer must compensate the seller's losses in proportion to their fault. However, the buyer is not responsible for changes or deterioration in the product due to proper use within the withdrawal period.

If the exercise of the right of withdrawal causes the total amount to fall below the campaign limit, the discount granted under the campaign will be canceled.

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED: The right of withdrawal cannot be exercised for products prepared in accordance with the buyer’s specific requests or clearly tailored to personal needs, including underwear, swimsuits, and bikini bottoms, makeup products, disposable items, perishable goods, products that may expire soon, or goods that are not suitable for return due to health or hygiene reasons if their packaging has been opened after delivery. Additionally, the right of withdrawal cannot be exercised for products that are inseparably mixed with other products after delivery, services provided within subscription agreements (except for newspaper and magazine subscriptions), digitally delivered services, and sound or video recordings, books, digital content, software programs, data storage, or computer supplies if the packaging has been opened.

DEFAULT AND LEGAL CONSEQUENCES: If the buyer defaults on a credit card payment, they agree to pay interest under the credit card agreement with the bank and be responsible for any legal costs incurred. In this case, the bank may take legal action, and the buyer may be liable for legal fees. The buyer also agrees to compensate the seller for any damages caused by the delay in payment.
